Eligibility of activities

1. What do the following expressions mean: 'works component' and 'soft project'?

   Works components are parts/activities of projects which involve construction or investment in infrastructure. (For the wording please refer to the PraG.) Soft projects are projects that contain no works components (e.g. which represent planning projects or projects containing only workshops or other events). Please be aware that the individual Actions have differing rules on whether they make works components possible or not. For more information, please consult the tables of the Actions under Chapter 3.2 of the Guidelines and in Chapter 4 of the Tourism Handbook.

2. Is it eligible to include the planning of an infrastructural investment and the actual construction of the same investment in the same project proposal?

   In accordance with the note included in Chapter 3.2 of the Guidelines it is not possible to include in the same project the elaboration of construction plans and the implementation of the construction activities themselves. Based on this, on one hand there can be projects in which one of the main activities is the planning of infrastructure. In these cases the elaboration of the architectural plans is listed e.g. on the budget line Services. On the other hand there can be projects in which the construction of the infrastructure is the main activity. In these cases the costs of the architectural plans can eventually be included under the budget line Preparation costs, if they meet the requirement. However, please be aware of the threshold concerning preparation costs (see Chapter 3.3.2.1 of the Guidelines).

3. What is the interpretation of 'land or building in the ownership of the state or of county/local governments' in Letter b) of Point 3 of Guidelines Chapter 4.2.3?

   According to the Guidelines, as a basic rule the land or building on which developments are to be effected within the cross-border project should be the property of the relevant Lead Beneficiary / Project Partner organisation. However, there can be situations where the development is to be implemented on property which will be rented for the purposes of the project. This is only possible if the owner of the land or building  to be rented is either the Hungarian or Croatian state or a Hungarian or Croatian local government (county or municipality government) of the eligible programme area.

   In this respect, property owned in 100 per cent by organisations which are in the 100 per cent ownership of the state or the local government can be viewed as being ‘in the ownership of the state or of county/local governments’. In these cases the ownership background of these organisation(s) will have to be clearly proven by documents (e.g. establishing document and extract from register), to be included in the project proposal.

4. During project implementation, what happens if the achievement of the project's indicators is not in line with the planned values?

    According to Article 14 of the Subsidy Contract for the Community funding, the Managing Authority is entitled to withdraw from the contract if, among others, \'the project has not been or cannot be fully implemented by carrying out the planned activities and results moreover by achieving at least 80 per cent of the quantifiable outputs\'. With reference to this possibility it is important to emphasize the realistic planning of the indicators in the project development phase.
